6. Policy Limit
This policy provides -
Limit of Liability $20,000,000
Indemnity provided forms part of a policy issued to others that meet the criteria outlined in this Proposal
7. Policy Excess
- $5,000 each and every claim, but
- $5,000 for any claim arising during open hours cleaning, and
- $25,000 for worker to worker claims arising at any time.
8. Definitions
Family Member means -
- any spouse, domestic partner or companion;
- any parent, or parent of the spouse, domestic partner or companion; or
- any sibling, child or adopted child.
- any person employed on a casual basis as a direct replacement for any person described in I., II. or III. above due to sickness, injury or annual leave but for not more than 30 continuous days.
Employee means any person employed under a contract of service or apprenticeship who is not a Family Member
9. DECLARATION AND AGREEMENT:
I declare in relation to the facts, statements and particulars contained above and as noted below -
- I have reviewed the Proposal;
- I confirm that to the best of our knowledge and belief, they are true and complete;
- I confirm that no material facts have been omitted, misstated, misrepresented or suppressed; and
- That should any of the information given by us alter we will give immediate notice to the insurer.
- I confirm that we are authorised by the Company and its Directors to complete, sign and submit this proposal on behalf of the Company and its Directors.
- I have been provided access to the full policy wording by Rutherford Insurance Services.
After full enquiry I am NOT AWARE of any claim been made against the business or any principal, partner, director or employee other than has been disclosed in 7. above.
After full enquiry the proposer is NOT AWARE of any circumstance or incident which has or could result in any claim being made against the proposer’s business other than has been disclosed in 7. above.
I declare that the statements and particulars contained in this Declaration are true and complete and that I have made no miss stated or suppressed any material facts.
10. Premium Payment
Annual Premium: Outside Business Hours Cleaning
$1,300.00 includes all taxes, fees and charges. This is an annual premium.
Annual Premium: During Business Hours Cleaning
$1,700.00 includes all taxes, fees and charges. This is an annual premium.
Annual Premium: During and/or Outside Business Hours and Turnover More Than $200,000
Calculated on an individual basis
All policies will expire on 1st September 2020 the table below sets out the premiums payable if your policy starts after 1st September 2019 (Below premiums do not apply for during and/or outside business hours with a turnover greater than $200,000.00)

IMPORTANT NOTICES
Your Duty of Disclosure
In order to make an informed assessment of the risk and calculate the appropriate premium, your Insurer needs information about the risk you are asking to insure. For this reason, before you enter into a contract of insurance, you have a duty under the Insurance Contracts Act 1984 (Cth) to disclose to your insurer every matter that you know, or could reasonably be expected to know, is relevant to the insurer’s decision whether to accept this risk and, if so, on what terms. The duty continues after the proposal form has been completed up until the inception date of the policy and also applies when you renew, extend, vary or reinstate a contract of insurance.
You do not have to disclose anything that:
- Reduces the risk to be undertaken by the insurer;
- Is common knowledge;
- Your insurer knows, or in the ordinary course of its business, ought to know; or
- If the insurer has waived your obligations to disclose.
One important matter to be disclosed is the history of losses suffered by the person or entity seeking insurance and possibly also losses suffered by any related or associated person or entity sough to be
covered by the relevant insurance policy. You are responsible for checking that you have made complete disclosure. We suggest that you keep an up to date record of all such losses and claims and that you make all reasonable enquiries of directors, officers, senior managers and any relevant employees in order to ensure that adequate disclosure has been made.

Consequences of Non-Disclosure
If you do not comply with your duty of disclosure, your insurer may be entitled to reduce its liability in respect of a claim or may cancel your contract of insurance. If the non-disclosure was fraudulent, the insurer may be able to avoid (or cancel) the contract of insurance from its beginning. This would effectively mean that you were never insured.
Material Changes
You must also notify your insurer of any significant changes which occur during the period of insurance. If you do not, your insurances may be inadequate to fully cover you. We can assist you to do this and to ensure that your contract of insurance is altered to reflect those changes.
